Davey Hospitality GroupDavey Hospitality GroupThese Terms of Service ("Terms") govern your access to and use of DHG Suite (the "Service"), a web application provided by Davey Hospitality Group LLC ("DHG," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
DHG Suite is software for hospitality operators to manage menu and recipe costing, inventory and par levels, prep lists, bar/FOH specs, and related kitchen operations. We may add, change, or remove features at any time.
The Service is currently offered in Early Access (beta). It is provided "as is," may contain errors, and may change or be interrupted. Keep your own backups of critical data.
You must provide accurate information, keep your credentials secure, be at least 18, and be authorized to bind your business. You are responsible for activity under your account.
You agree not to use the Service unlawfully, upload content you don't have rights to, attempt to breach security or access other customers' data, disrupt the Service, reverse engineer or resell it except as allowed by law, or upload malware.
You retain ownership of the data, recipes, images, and videos you put into the Service. You grant DHG a limited license to host, process, and display it solely to provide the Service. You are responsible for the legality and accuracy of your content and for having rights to any media you upload.
During Early Access the Service is free. When paid plans launch, fees and billing terms will be shown at sign-up and charged via Stripe. Subscriptions renew automatically until cancelled; fees are non-refundable except where required by law; you authorize recurring charges and are responsible for applicable taxes.
The Service, including its software, design, and trademarks, is owned by DHG and its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service.
The Service relies on third parties (e.g., Supabase, Netlify, Stripe). Your use may be subject to their terms, and we are not responsible for their acts or omissions.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. We do not warrant that costing, pricing, or other outputs are accurate or suitable for your business decisions; you are responsible for verifying them. The Service is not legal, financial, tax, or food-safety advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DHG WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM OR (B) US $100.
You will indemnify and hold DHG harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or law.
You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms.
We may update these Terms; material changes will be posted or emailed. Continued use means you accept them.
These Terms are governed by the laws of the State of Texas; venue lies in the state or federal courts located in Texas.
